Hamilton Central Business District
- Strategic Alignment with Future Proof and Hamilton Urban Growth Strategy

Overview

Variation 21 makes changes to the District Plan zoning rules to align the Proposed District Plan with Future Proof (the sub-regional growth strategy) and the Hamilton Urban Growth Strategy (HUGS).  The variation also brings the Proposed District Plan in line with Council's spending through the Long-Term Plan on public infrastructure, parking, and pedestrian areas in the central city.

The variation recognises Hamilton's Central Business District as being the main commercial centre for the sub-region and introduces new policies and rules that are intended to help maintain the city heart as the vibrant retail, business, arts and social heart of the sub-region.  The variation does this by improving management of future retail, business and industrial activities. 

In particular the new provisions promoted through the variation:

  • Retain flexibility for retailing, offices and other intensive activities to occur in the City Centre Zone;
  • Retain similar flexibility including providing for 'Big Box' retailing and offices in the new Central Commercial Service Zone (To apply to the existing Commercial Service Zone that surrounds the City Centre Zone);
  • Require Discretionary activity resource consent for retail, office, and other intensive activities in the General Commercial Service Zone; and
  • Require Non-complying activity resource consent for all large retailing activities, Discretionary resource consent for small offices and Non-complying activity resource consent for large office developments in the Industrial Zone.

There are no changes to boundaries of any Proposed District Plan Zones as a result of the variation.

Current Status

Earlier on in the year, Waikato Tainui Te Kauhanganui Incorporated initiated judicial review proceedings against Council’s decision to publicly notify Proposed District Plan Variation 21 prior to consulting with Waikato Tainui as the iwi authority. The High Court ruling of 3rd June is in favour of Waikato Tainui and means that Variation 21 no longer forms part of the Proposed District Plan.

Council has now ceased its processing of Variation 21.
