Hamilton City Refuse Bylaw 2002 Review

Summary of proposed changes

City Council is proposing:

  • that the existing Hamilton City Refuse Bylaw 2002 be revoked and that it be replaced with the Hamilton City Solid Waste Bylaw 2012
  • that the new bylaw allows Council to license waste collectors, transporters and operators, through the powers of the Waste Minimisation Act 2008, Section 56(3)
  • that the new bylaw is consistent and is an implementation tool for the proposed Waste Management and Minimisation Plan.

The purpose of this bylaw is to prohibit or regulate the dsposit of waste; regulate the collection and transportation of waste regulate the manner of disposal of dead animals, including their short-term storage pending disposal; prescribe changes to be paid for the use of waste management and minimisation facilities provided, owned, or operated by the territorial authority; prohibit, restrict, or control access to waste management and minimisation facilities provided, owned, or operated by the territorial authority; prohibit the removal of waste intended for recycling from receptacles provided by the territorial authority by anyone other than 1) the ocupier of the property from iwhch the waste in the receptacle has come, 2) A person authorised by the territorial authority to remove the waste.

Proposed Waste Management and Minimisation Plan

Summary of proposed changes

The proposed Waste Management and Minimisation Plan sets a new direction for Hamilton City Council in regard to future waste minimisation and management. The plan has been informed by a preceeding waste assessment which assessed the current waste services within the city (public and private). The proposed Waste Management and Minimisation Plan describes Council's vision and how it will meet its long term goals for waste management and minimisation for the city. It sets objectives, policies and actions to achieve the vision and includes a framework to monitor and measure progress. It also provides information on how the Council intends to fund the actions of this plan over the next six years.

Hamilton City Council is proposing that the proposed Waste Management and Minimisation Plan be adopted.
